Court Decision Makes Selling Digital Music Files Difficult – A Manhattan court recently came to a decision in a suit by Capitol Records against ReDigi for copyright infringement in the reselling of “pre-owned” digital music files. ReDigi claimed they only provided a marketplace allowing users to sell directly to others. And that upon sales, source tracks were deleted from their servers so no additional digital copies were made. However, the district judge concluded that ReDigi “infringes Capitol’s reproduction rights under any description of technology.” This may not be the final word on the matter. Both Amazon and Apple have applied for patents covering an online mechanism allowing a customer to sell or transfer digital goods—including MP3 tracks, E-books and digital videos which usually cannot be resold once used. In the meantime, don’t sell your old music server with the music files still on its hard drive, or make digital copies of vinyl publically available, because nearly everything is copyright and someone could sue you.
